The Trump administration is arguing that it is not required to bring a suspected MS-13 gangbanger back to the United States after he was repatriated to his home country of El Salvador.

The federal courts have no authority to dictate White House foreign policy, the Department of Justice (DOJ) wrote in the latest court filings regarding Abrego Garcia, an illegal migrant who was deported back to El Salvador in March and sent to the Central American country’s infamous mega-prison. Lawyers for Garcia had demanded that the Trump administration facilitate his return back to the United States. 

“The federal courts have no authority to direct the Executive Branch to conduct foreign relations in a particular way, or engage with a foreign sovereign in a given manner,” lawyers for the DOJ wrote in a court filing Sunday. “That is the ‘exclusive power of the President as the sole organ of the federal government in the field of international relations.’”

Garcia’s lawyers are making demands that exceed constitutional authority because they are asking federal U.S. officials to extract from a sovereign nation one of their own citizens from their custody, the Trump administration argued in court.

“Such power is ‘conclusive and preclusive,’ and beyond the reach of the federal courts’ equitable authority,” the DOJ said. “But as explained, a federal court cannot compel the Executive Branch to engage in any mandated act of diplomacy or incursion upon the sovereignty of another nation.”

The court battle over Garcia’s fate began when Immigration and Customs Enforcement (ICE) agents apprehended him in March and quickly transferred him to the Terrorism Confinement Center (CECOT), a mega-prison in El Salvador built specifically to detain members of organized crime syndicates such as MS-13 and Tren de Aragua.

Garcia unlawfully entered the U.S. in 2011 and made his way to the Maryland area, according to court documents. Accusations that he was associated with MS-13 began when he was arrested in 2019 by the Prince George’s County Police Department in Maryland, with an informant telling local law enforcement Garcia’s alleged gang nickname and rank within the gang.

Garcia was eventually granted withholding of removal, and an immigration judge in 2019 agreed to his claims that he would face torture if deported back to El Salvador. The benefit, which is similar to asylum, barred the government from repatriating him back to his home country and allowed him to work in the U.S.

While the Trump administration has acknowledged that Garcia’s deportation was the result of an administrative error, the White House has also stood by his removal, arguing that he is a member of MS-13 — a designated foreign terrorist organization — and should remain in law enforcement custody.

“The administration maintains the position that this individual, who was deported to El Salvador and will not be returning to our country, was a member of the brutal and vicious MS-13 gang,” White House Press Secretary Karoline Leavitt said earlier in April. “Fact number two, we also have credible evidence that this individual was involved in human trafficking.”

U.S. District Judge Paula Xinis, an Obama administration appointee, ordered the administration earlier in April to return Garcia quickly back to the U.S., but the Supreme Court pumped the brakes on her mandated deadline. However, the nation’s highest court on Thursday ruled that the administration must facilitate his return while ordering Judge Xinis to clarify what she meant by effectuate “with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs.”

The back-and-forth comes as El Salvador President Nayib Bukele is set to meet President Donald Trump in Washington, D.C., on Monday. Bukele has proved instrumental in Trump’s large-scale deportation agenda, with the El Salvadoran leader agreeing to take in Trump’s deportees of suspected MS-13 and Tren de Aragua gang members, and other allegedly heinous criminal illegal migrants.

Democrats in Maine claim THEY can decide which lawmakers have a right to vote on legislation

Democrats in Maine are arguing in court they can decide which lawmakers can vote in the legislature, essentially that an elected lawmaker has no right to vote there because of her conservative views on transgenderism, even though a majority of the state’s residents support her perspective, not that of the leftists in the legislature.

The startling and extremist claim was made by Maine Attorney General Aaron Frey, a far leftist who has been trying to get the courts to dismiss a First Amendment fight brought by Rep. Laurel Libby, a Republican who was deprived of her constitutional right to vote by majority Democrats because she criticized their agenda to promote transgenderism.

Frey, a Democrat, made the claim while failing to get the case dismissed.

According to the Washington Stand, Frey demanded, “Rep. Libby does not have a First Amendment right to vote, as a legislator, on any particular piece of legislation.”

He claimed that the state House can “discipline” its members any way it wants.

WND reported that “discipline” was by Democrats who stripped the elected Republican lawmaker of her right to speak in the legislature, or to vote there.

The fight blew up into the headlines when President Donald Trump said the federal government’s position is that there are two genders, male and female, and males should not be in women’s sports.

Maine Gov. Janet Mills publicly defied the president, prompting the federal government to begin withholding federal funds to Maine, as well as federal investigations into possibly federal law violations by the state.

The fight has left Maine in “noncompliance with Title IX,” and a poll by the University of New Hampshire showed 64% of the state’s residents say transgender athletes “definitely should not” or “probably should not” participate in girls’ and women’s sports.

Libby meanwhile, sued the Democrats in the state legislature for censoring her because of her views.

House Democrats in the state have claimed that his Democrat party had to “punish” Libby for her beliefs.

The case is being heard by Judge Melissa Dubose of Rhode Island, because one of the transgender athlete’s parents works in the federal court system in Maine, creating a conflict of interest in the case for that entire network.

The report explained Assistant Attorney General Kimberly Patwardhan told the court that Libby’s representation of her constituents is unaltered, even though she cannot express their opinions on issues, measures and laws.

Libby has charged the Democrats, in fact, are depriving all of her constituents of their right to be represented in the lawmaking body.

Free speech advocates say the case should be an easy victory for Libby.

“There is little question the House majority targeted Rep. Libby because of her viewpoint,” said a filing from the Foundation for Individual Rights and Expression. Democrats there, in fact, are doing “an end-run around the super-majoritarian provisions of the Maine Constitution” and “an egregious violation of the First Amendment.”

Democrats insist they can disenfranchise all of the voters in Libby’s district when they choose.

Libby had posted an image of a boy who calls himself a girl winning a girls state championship on Facebook.

“District 90 now stands voiceless on the House floor — unable to vote, unable to speak, and unable to be represented on matters ranging from an $11 billion state budget to local priorities impacting working families. The inability to speak to that legislation, especially in the minority, where it may not change the outcome but can at least register the opinion of my district, is crucial.” Libby charged.

FIRE also pointed out that, as often happens, Democrats have not consistently applied the same standard being used to attack Libby to all.

Legislators took no action against Rep. Vicki Doudera (D-41) after she shared the name and photo of an underage chess champion on social media, the report noted.

A U.S. Navy veteran and his wife were subjected to the full weight of the government’s iron fist as Child Protective Services—backed by armed deputies—stormed their home and seized their one-month-old, breastfeeding infant.

There was no warrant. No due process. No criminal charge.

This happened not in communist China, nor in North Korea. It happened in suburban Virginia. In America. In 2025.

Farzin Yazdani, a Navy veteran, father, and respected engineer, has become the latest victim of a weaponized family court system—a system increasingly aligned with radical bureaucrats and progressive ideologues who seem hellbent on dismantling the American family under the guise of state welfare.

“I’m begging everybody who’s reading this that there’s a crime in progress currently, Loudoun County Government has abducted and falsely imprisoned a one-month-old breastfeeding baby from its innocent mother. Loudoun County Child Protective Services (CPS), flanked by armed deputies from the sheriff’s department, stormed the Yazdani home in what the father describes as a “coordinated ambush” based on a false affidavit from a bitter ex-wife embroiled in a custody battle.

The infant—completely healthy, cared for, and bonded to her mother—was removed with zero regard for constitutional rights, familial bonds, or even basic human decency.

Yazdani wrote in a post on X:

“This is government terrorism. And every man in America needs to understand: if it can happen to me, it can happen to you.

I may have been the target of an investigation. There are no charges or litigation pending against me. If they bring some, Fine—I’ll face it. I’ll fight it. But what justifies taking my children away from their innocent mother? What justifies ripping a one-month-old breastfeeding baby from the woman who carried her, nurtured her, and has never been accused of anything?

There is no justification. There is no logic. There is only cruelty.

This is what happens when the system convinces itself you’re a “bad guy.” It doesn’t need proof. It doesn’t need due process. It just needs perception. One bitter ex, one dishonest affidavit, and suddenly, the state throws its full weight at you—not just to punish you, but to destroy your family.

Even when the lies are exposed—even when you have recordings, evidence, proof of innocence—they don’t stop. The stain of the accusation is enough. And now I’m under scrutiny, treated like I need to be controlled, while the people I love most are used as leverage in this twisted game.

The October 14 Raid: A Family Torn Apart

Yazdani says the trauma began long before this latest attack. In October 2024, Loudoun County deputies arrived with his ex-wife and her new husband to forcibly remove his 5-year-old son—without investigation, warrant, or questions.

Yazdani, calm and compliant, was placed in handcuffs by Deputy Stephen V. Mieszala, who would later be caught withholding body cam footage and showing up at custody hearings alongside the ex-wife.

Yazdani wrote:

On October 14th, 2024, at 3:00 p.m., I was exercising my court-approved visitation with my son when my ex-wife, Amanda, showed up unannounced and uninvited to my brother’s home—the former residence of my late father.

She brought with her Deputy First Class Stephen V. Mieszala (#3343) of the Loudoun County Sheriff’s Office. I had calmly asked for an extension to my weekend visit. Amanda refused—and instead escalated the situation by bringing law enforcement to a peaceful home.

What happened next was pure abuse of power.

Without cause, warrant, or investigation, Deputy Mieszala immediately placed me in handcuffs, ignoring the fact that I was calm, cooperative, and clearly trying to de-escalate.

You will hear in this video the most painful part of all:
My 5-year-old son screaming and begging to stay with me—his father—as I’m arrested in front of him. That is a sound I will never forget.
And neither will he.

This moment shattered more than just my pride. It devastated my relationship with my brother, a law-abiding citizen who now believes I brought shame and scrutiny to his home. We haven’t spoken since.

I am a U.S. Navy veteran, an engineer, a business owner, a father, and a homeowner in Loudoun County. I have no criminal history. I’ve served my country and community honorably. And still, I was treated like a criminal—with my son forced to watch.

Deputy Mieszala later falsely claimed he witnessed an assault, alleging that I “retreated into the house” and the door struck Amanda. But the body cam footage—which he withheld—proved that never happened. In fact, if he had actually witnessed an assault, why was I detained while he “investigated”?

During the arrest, I told him the cuffs were too tight. Instead of loosening them, he tightened them further. I was placed in a hot patrol car without airflow, left to suffer. Even after the magistrate released me on my own recognizance, I was held for 6.5 more hours under the excuse of a “shift change.” That’s not procedure. That’s punishment.

The charge? Nolle prosequi.
Dismissed.
Because there was no evidence, no crime, and a lying officer who withheld the truth.

Deputy Mieszala is now a witness for Amanda in our custody case—using his badge and the credibility of his office to further a personal agenda. This is weaponization of law enforcement, plain and simple.

Fast forward to March 28, 2025. Loudoun County CPS, led by employees like Kellie Hendricks and Chandler Evans, escalated their attack.

Without warning, warrant, or evidence, they stormed Yazdani’s home, backed by armed deputies, and demanded his one-month-old daughter, Roxana. The baby, still breastfeeding and wholly dependent on her mother, Emily, was taken at gunpoint.

Loudoun County CPS, with no emergency declaration and no warrant, arrived to seize baby Roxana—just 1 month old—from her mother’s arms. The baby, still breastfeeding, was taken by force. No medical emergency. No risk of harm. Just a social worker acting on hearsay, backed by armed government muscle.

For eight excruciating days, Roxana remained in government custody. She was reportedly injured while under state care—a fragile newborn, taken from her source of nourishment and placed in a cold, impersonal system known for traumatizing the very children it claims to protect.

Video evidence now released by Yazdani shows the disturbing truth: law enforcement and CPS agents operating more like a paramilitary unit than civil servants. Deputies admit on camera that they weren’t briefed on the facts. One says, “We’re just here to enforce,” even when told the child was only 1 month old.

The Fight Continues

After eight days of torment, Farzin Yazdani and his wife, Emily, reclaimed their daughter.

Yazdani said in a video update:

“It’s really disheartening that elements of the Left in Loudoun County believe that they have more rights to my children than I do—that they know better for my kids than I do—that they can come here illegally, abduct my kids at gunpoint, and take them for five days without arresting me or charging me with anything.

I don’t have a criminal history or background. I didn’t do anything wrong. Anything alleged against me right now is just from a former ex, and the source of it is a former ex with an axe to grind—who I’m in custody court with right now.

It’s outrageous that they can weaponize government to the point that they come and take a breastfeeding baby from its mama. Innocent, both of them.

The ex is accusing me of XYZ, and that’s fine—I’ll fight it in court. No problem with that. But what did this baby do? What did her mama do? This is not right.

This can happen to you. If you think this can’t happen to you, and that taxpayer-funded family destruction is something that is okay—you must be liberal. You must be a liberal Democrat to believe that taxpayer-funded family destruction is okay—to rip a one-month-old breastfeeding baby away from its mama, both innocent, without due process, without an emergency.

It was all dismissed on a motion to strike.”

Though Roxana is now back with her parents, the battle is far from over. Yazdani has launched a lawsuit against Loudoun County CPS and multiple actors involved, including Deputy Mieszala and CPS agents who illegally seized and placed the baby into the foster-to-adopt system.

Legal costs are mounting—over $375,000 and growing by the day. But Yazdani isn’t just fighting for his own children. He’s fighting for yours.

According to the fundraising campaign:

This was a coordinated attack—no warning, no chance to respond, and no attempt to verify the truth.

Anti-Trump ‘resistance’ leader’s campaign bankrolled by Dem power broker tied to Chinese intel

Boston Democratic Mayor Michelle Wu’s 2021 campaign received hundreds of thousands of dollars from a fundraiser who is listed by a Chinese intelligence agency as an official, a Daily Caller News Foundation investigation discovered.

Gary Yu, the founder of Boston International Media Consulting, helped raise over $300,000 for Wu with the help of a Chinese civic association he leads. However, Yu — whose Chinese name is Yu Guoliang — is listed as an official by an agency of a Chinese Communist Party (CCP) influence and intelligence service called the United Front Work Department (UFWD), and also operates as a recruiter for the Chinese government, according to reports from the CCP, Chinese state media and civic associations led by Yu.

“The Communist Party’s UFWD never rests,” author and China expert Gordon Chang told the DCNF. “There is no ethnic Chinese official in America who is not targeted. It’s time for law enforcement to investigate the CCP’s ties to Gary Yu and Yu’s ties to Mayor Michelle Wu.”

Wu has risen to national prominence as a central figure in the Democratic resistance to Trump’s border and deportation policies. Wu recently defended her city’s refusal to cooperate with immigration officials during her March 19, 2025 “State of the City” address, during which she criticized “presidents who think they are kings,” prompting the White House to fire back the next day with a press release labeling Wu a “radical mayor” who “puts violent criminal illegal aliens first.”

“Wu’s ultra-leftism makes her the perfect candidate for CCP recruitment and capture,” Chang said. “Or do we have it backward? Is her ultra-leftism the result of CCP recruitment and capture? More than just the people of Boston would like to know.”

Wu’s office, Yu, and Boston International Media Consulting did not respond to multiple requests for comment.

‘Overseas Chinese’

Yu has repeatedly met with high-ranking CCP intelligence leaders in China and is listed as an official by two regional branches of a UFWD arm, according to Chinese government announcements, state media reports and records from Chinese civic associations led by Yu.

The UFWD’s operations are a “unique blend of engagement, influence activities, and intelligence operations that the [CCP] uses to shape its political environment, including to influence other countries’ policy toward the [People’s Republic of China] and to gain access to advanced foreign technology,” according to the House Select Committee on the CCP.

Yu is identified as an “overseas committee member” by the Hangzhou municipal All-China Federation Of Returned Overseas Chinese (ACFROC) branch in Zhejiang province and has met with their officials in China multiple times, according to the website of the North American Hangzhou Association (NAHAUS), where Yu serves as chairman.

ACFROC is a UFWD agency specializing in overseas influence operations, including allegedly directing Chinese community leaders to illegally establish a secret Chinese police station in New York City.

“China’s strategy to influence state and local policymakers is executed, in part, through hundreds of ostensibly ‘civil society’ organizations that are actually affiliated with the CCP’s UFWD,” Michael Lucci, CEO of State Armor, a nonprofit focused on countering the CCP, told the DCNF. “Xi Jinping considers United Front work a critical tool to undermine democracies. It involves influence peddling, intelligence collection, and intellectual property theft, all for the end goal of aligning U.S. subnational governments with China’s foreign policy and exploiting weaknesses they find.”

NAHAUS’s website details one meeting in China between Yu and the Hangzhou ACFROC Communist Party secretary on Nov. 29, 2018. During the meeting, Yu said NAHAUS would “work tirelessly to support the construction of Hangzhou and continue to serve the function of uniting and leading overseas Chinese,” according to a Chinese social media post that includes a photo of Yu alongside the ACFROC Party secretary.

Yu is likewise listed as an “overseas committee member” by the Zhejiang ACFROC branch, and he also met with officials from that group in China in November 2018, according to NAHAUS’ website. In March 2023, Yu participated in a Zhejiang ACFROC overseas advisory committee webinar, according to Zhejiang ACFROC. During the webinar, Yu and other ACFROC officials discussed matters such as building overseas coalitions.

‘Talent Recruitment’

Yu also agreed to headhunt U.S. talent for at least half a dozen Chinese regional governments, including the cities of Hangzhou and Guangzhou, according to Chinese government and ACFROC announcements.

For instance, in November 2019, the CCP announced that Yu agreed to establish an “Overseas Talent Recruitment Work Station” in North America for the party’s Organization Department in Nanning, a city located in the Guangxi Autonomous Region.

The Organization Department oversees China’s malign talent recruitment programs, like the Thousand Talents Plan, which incentivizes participants to “return to China to augment its scientific and military capabilities,” according to the U.S.-China Economic and Security Review Commission.

Yu has also agreed to help recruit U.S. talent to support China’s high-tech development, including in the field of artificial intelligence.

Guangxi’s ACFROC branch recently announced that Yu had met with its officials on March 27, 2025. During that meeting, Yu promised to continue introducing “top-quality resources to Guangxi” after the ACFROC chairwoman told him the region’s artificial intelligence industry urgently required “overseas high-level talents.”

A November 2018 article by the Chinese media outlet Sohu reported Yu had previously headhunted for the Chengdu government’s High-Tech Zone and Tianfu Software Park, which are home to multiple Chinese military companies sanctioned by the U.S.

Department of Defense, including Chengdu JOUAV Automation Tech Co., Chengdu M&S Electronics Technology Co., Tencent, and Huawei.

‘Unlimited Power’

Meanwhile, Yu has organized the Chinese American community in Massachusetts to canvas and raise hundreds of thousands of dollars to elect Democratic lawmakers like Wu.

Massachusetts Office of Campaign and Political Finance (OCPF) records show Yu has personally donated $45,515 to various Massachusetts Democratic politicians since 2018, including $3,200 to Wu and $2,175 to Gov. Maura Healey.

Among other leadership roles, Yu also serves as the co-chair of the New England Chinese American Alliance (NECCA), which has “actively engaged the Chinese community in political campaigns,” according to the nonprofit’s website. Toward that end, NECCA has hosted “fundraising events” for at least nine Massachusetts politicians including Wu and Healey.

NECCA’s website claims it “raised over $300,000 from the Chinese American community for Michelle Wu,” and Yu’s Twitter advertised fundraising events for the future mayor in November 2020 and June 2021.

“We organized so many fundraisers and translated campaign materials into Chinese for more Chinese residents to read,” Yu said about his work for Wu, according to a November 2021 Boston University News Service (BUNS) report. “We did street canvassing every week. We had unlimited power for supporting her in the past year.”

By September 2021, NECCA had “expanded the fundraising scope from the Greater Boston area to more than 30 states across the country,” BUNS reported.

“Public officials need to thoroughly vet any organization and individual that has ties to China’s government, and interface with state and federal law enforcement when there is any uncertainty,” Lucci told the DCNF. “It is well-known that China’s government seeks to influence U.S. politics and place agents within our governance systems to further the CCP’s agenda. We need to stop letting them get away with it.”

Yu also donated $3,000 to Massachusetts State Auditor Diana DiZoglio, OCPF records show.

DiZoglio added Yu to her “policies and priorities” transition team after winning her race for state auditor in June 2021, and later appointed him to serve as a commissioner on the state’s Asian American and Pacific Islanders Commission (AAPIC) in January 2024.

Yu now serves as vice chair of AAPIC, which describes itself as “the Commonwealth’s only permanent, statewide body dedicated to addressing the needs and challenges of the AAPI community.”

AAPIC’s chairman, Saatvik Ahluwalia, told the DCNF by email the organization was completely “unaware” of any activity between Yu and ACFROC.

“[T]his is the first time we have heard of ACFROC, and we’ve had no contact, affiliation, or engagement with either the organization or the Chinese Government,” Ahluwalia said. “We absolutely intend to investigate what you outlined in your questions, including talking directly to Mr. Yu.”

NECCA, Healey, and DiZoglio did not respond to multiple requests for comment.

Balmer will be charged with attempted murder, terrorism, aggravated arson and aggravated assault against an enumerated person, according to officials.
