Federal judge tosses Trump admin Harvard admissions lawsuit, leaves door open to future challenge

November 3, 2026 MMN Editor Filed Under: THE NEWS

A federal judge on Monday dismissed the Trump administration’s lawsuit seeking to force Harvard University to turn over admissions records as part of an investigation into whether the Ivy League school continues to consider race in its admissions process.U.S. District Judge Myong Joun ruled that the Justice Department had not adequately established that it followed required procedures before suing Harvard to obtain applicant-level admissions data. The dismissal was issued without prejudice, leaving the door open for the administration to file another lawsuit if it addresses the procedural deficiencies identified by the court.”The Government may be able to identify a qualifying determination or cure the procedural deficiency, but it has not supplied a sufficient basis for the judicial relief currently sought,” Joun wrote in his 10-page decision.TRUMP ADMINISTRATION ACCUSES PRESTIGIOUS LAW SCHOOL OF FAVORING BLACK APPLICANTS OVER WHITE, ASIAN PEERSThe Justice Department filed its lawsuit in February, alleging that Harvard had failed to cooperate with a federal civil rights review examining whether the university’s admissions practices comply with the Supreme Court’s 2023 ruling limiting the use of race in college admissions. The Justice Department alleged that Harvard repeatedly delayed producing requested documents and failed to provide individualized admissions records despite multiple requests and extended deadlines.JUDGE’S HARVARD ANTISEMITISM RULING SENDS TRUMP JUSTICE DEPARTMENT BACK TO DRAWING BOARDIn announcing the lawsuit in February, then-Attorney General Pam Bondi accused Harvard of withholding information necessary for the government’s review.”Harvard has failed to disclose the data we need to ensure that its admissions are free of discrimination,” Bondi said at the time.Joun acknowledged that federal officials had made repeated requests for records and warned Harvard of potential enforcement action. But the judge found that the government’s court filings failed to adequately demonstrate that officials had followed the required procedures before seeking judicial intervention. In particular, Joun noted that the Justice Department’s complaint did not allege that officials had notified Harvard of their intent to pursue litigation if the university failed to comply or adequately identified the specific compliance failure at issue.HARVARD, NYU AMONG 30 UNIVERSITIES HIT WITH PENTAGON FOREIGN-TIE AUDIT DEADLINEJoun also found that the Department of Education had not sufficiently demonstrated that it followed its own required procedures before referring its separate admissions investigation for judicial enforcement.Harvard’s attorneys argued that the lawsuit was part of a broader retaliatory campaign by the Trump administration after the university resisted demands for changes to its governance and academic policies, according to Reuters. The judge did not rule on Harvard’s retaliation claims, stressing that his decision addressed procedural deficiencies rather than whether the university had violated federal civil rights law.”Nothing in this decision converts the Government’s request for information into an accusation of present discrimination or resolves Harvard’s underlying Title VI compliance,” the judge wrote.Fox News Digital has reached out to the Justice Department, Department of Education and Harvard University for comment.

Joe Mixon, a two-time NFL Pro Bowl running back, came to the harsh realization he had been aboard the private jet that plunged out of the sky and crashed onto a Florida highway. The former Cincinnati Bengals and Houston Texans star wrote on social media on Monday he was on the same plane about a month ago.THE CRAIG CARTON SHOW–UNFILTERED, UNAPOLOGETIC AND UNMISSABLE. DOWNLOAD HIS DAILY PODCAST NOW!”Absolutely devastated by yesterday’s tragic plane crash in Florida and the loss of all nine lives,” he wrote on X. “I flew on that exact aircraft last month with those same two pilots. They were incredible professionals and genuinely wonderful people. Hearing the young woman’s story and learning about the bright future she had ahead of her makes it even more heartbreaking that her life was cut so short.”My heart, thoughts, and prayers go out to the grieving families and loved ones of everyone on board. A tragic reminder of how fragile life is. Love on your loved ones while you can, because you never know what tomorrow may bring.”The Learjet 60 crashed in a Palm Beach County neighborhood on Sunday. The National Transportation Safety Board (NTSB) said Monday there were indications the jet was breaking apart before the fiery wreck and that investigators were zeroing in on weather conditions being a major factor in the incident.CLICK HERE FOR MORE OUTKICK SPORTS COVERAGE”The weather conditions are a major focus of the investigation,” NTSB member Tom Chapman said at a news conference. “You all saw what the weather was like here at the surface. What we have to determine is what the weather conditions were like at altitude.”Later Monday, the nine victims of the crash were identified.Nathalia Gadelha Filgueiras, 20, was the co-pilot, Jeff Gregory, 55, was the pilot in charge, Adam Robinson, 45, was a Texas tech entrepreneur and was traveling with his wife Helen Sharp and their two children and Rachael Reed and Charmi Fehr, who were traveling together and building their lives together.Gadelha Filgueiras was an aspiring commercial pilot from Palm Beach County who earned her private pilot’s license at 17, before she got her driver’s license. Leftists Flee Trump’s America In Search Of Utopia In Europe

Leftists Flee Trump’s America In Search Of Utopia In Europe

It’s not really a secret that Europeans are conditioned from birth by their own establishment media to view the US as a terrible, racist and dangerous place with a faltering economy and no subsidies for citizens.  This propaganda program has been ongoing for decades and is designed to give Europeans a false sense that their socialist-leaning systems are far superior to the more free market American alternative. In reality, most of Europe is trapped in an economic tar pit and they are slowly sinking.  Mass immigration from third world countries is giving the public a taste of the many problems that come with demographic disruption.  And, the gun rights in America that Europeans often mock as “insanity” are starting to look pretty to them now that their governments are engaging in mass censorship and authoritarian arrests over online speech.  With the arrival of the FIFA World Cup and millions of tourists from across the Atlantic over the summer, suddenly common Europeans are beginning to realize that maybe they’ve been lied to their entire lives about the US.  Leftists living in America, however, still hate the country and everything it stands for with a passion. They dream of immigrating to Europe where they believe a Utopia awaits them; a place where opposing facts and mean words will never reach them.  A place where conservatives are suppressed and leftists are revered. And we would like to send them a message:  Dare to dream!Leaving the US is the best decision these people could possibly make.  Transgender couple say they were “terrified” living in America after fleeing to Ireland to claim asylum. “We were terrified. I was faced with threats of r***, threats of beatings and threats of death.” https://t.co/Echc6KW5fJ— Oli London (@OliLondonTV) October 30, 2026France 24 has released a series of reports on the changing political tides in the US, focusing on American citizens leaving for Europe in terror of what might happen to them under the Trump regime.  Their fears are rather vague and they can’t seem to present many specific examples of “fascist” crimes committed by Trump or conservatives.  What they can do, though, is blow normal policy decisions out of proportion and dramatize these changes as if they are horrific violations of human rights.  Keep in mind, France is currently in the midst of violent riots led by communists and third world immigrants, and the UK is trying to silence dissent from anyone speaking out against government policies.  In these countries, only certain people from specially privileged groups get to speak their minds; for everyone else, there’s always a chance that on any given day they will be arrested for what they think. There are three trespasses consistently held up by American leftists as their reasons for wanting to leave for “brighter shores”:  Immigration controls, restrictions on transgender treatments and ideology, and changes to abortion laws. The west is currently under siege by third world immigration, facilitated by liberal political leaders under the guise of “multiculutralism”.  Throughout the rest of the world, though, most nations have strict rules on who they allow to cross their borders.  Why is it that the US and Europe are the only places constantly criticized by leftists for wanting the same limits?  We all know the real reason why (their goal is to burn the west down).  What about transgender treatments and gender fluid ideology?  When leftists complain about this issue they are really complaining about the banning of gender treatments for kids.  The UK also restricts such treatments and has closed down their only dedicated gender facility for children.  Even the UK has some common sense. As for neo-pronouns and gender fluid ideology, US free speech laws prevent such nonsense from being forced on the public.  Furthermore, there is no concrete science whatsoever to support gender fluidity as a reality.  The only practical science on this issue shows that a tiny number of people have a mental illness (gender dysphoria) which needs to be addressed and treated.  If we make these people a protected class, then why not every other mental case?  When a schizophrenic declares himself to be king of the world, is everyone required to pretend that his delusions are real?  If the answer is no, then why should anyone be expected to support the delusions of trans people?  And then comes the abortion debate, which has been twisted into an argument over “women’s rights.”  When Roe V. Wade was decided in 1973, the assertion was that abortion would be “safe, legal, and rare.”  The rare part was quickly forgotten.  The case ignored the rights of states to address the problem on their own terms, and, it also ignored the rights of unborn children.  For some reason, the left has become obsessed with killing babies.  So obsessed that they base their entire political identities around this one topic.  Without the ability to kill babies, feminists argue that they are now slaves. What they really mean is, they think they should never be forced to suffer consequences for their actions. The western world has had enough of this kind of female entitlement.       Europe appeals to leftists because two tier systems are an absolute reality there.  This is the exact kind of world that progressives want to live in.  More power to them.  It’s about time that progressives stop trying to force their unpopular cult-like beliefs on Americans and find another place where their ideals are shared.  They whine constantly about the US being a fascist, racist, backwards society, so why stay?  When they actually put their money where their mouth is they should be applauded.  America needs more of this.
