DOJ faces ‘heavy lift’ in Alaska election appeal as separate criminal probe continues

November 3, 2026 MMN Editor Filed Under: THE NEWS

The Justice Department faces an uphill legal battle in its bid to overturn a federal judge’s dismissal of its Alaska Senate election lawsuit, according to legal experts who questioned whether the government can secure meaningful relief before voting ends Tuesday — even as a separate criminal investigation continues.DOJ filed a notice of appeal after Obama-appointed U.S. District Judge Sharon Gleason dismissed its lawsuit Sunday over the presence of two candidates named Dan Sullivan on Alaska’s Senate ballot. The judge ruled that federal officials lacked standing because they had not demonstrated how its proposed remedy could address potential voter confusion without compromising ballot secrecy. With voting ending Tuesday, attorneys told Fox News Digital that even a successful appeal could leave the government scrambling to obtain an injunction or return to district court, while a defeat would leave the civil case dismissed without necessarily affecting potential criminal charges arising from the alleged recruitment of the second Sullivan.DOJ SET TO APPEAL RULING IN ALASKA SENATE RACE DISPUTE OVER ‘DECOY DAN’”The federal judge dismissed on a procedural issue — standing,” election attorney Jason Torchinsky of Virginia-based firm Holtzman Vogel told Fox News Digital. “So if the government were to prevail, it would either have to seek injunctive relief from the appeals court in the first instance; a very high bar, or go back down to the district court to seek relief.””Given the time available between now and close of polls [Tuesday], this is a heavy lift for the government,” Torchinsky added.A reversal would not automatically change Alaska’s election results. DOJ would still need to obtain specific judicial relief, potentially requiring further proceedings in district court.Former federal prosecutor and ex-Pentagon official Cully Stimson similarly said that DOJ will have difficulty securing any immediate relief in its effort to pause the Sullivan-Peltola contest. While Gleason was appointed by Obama, Stimson suggested the ruling did not appear partisan and said uncertainty remains because voting had not yet concluded.”I’m not surprised that the judge did this. I don’t think it would matter whether an Obama judge or any other judge appointed by any other president,” Stimson told Fox News Digital.”Asking for injunctive relief way before anything even happens is a reach,” he said, adding Alaska falls under the San Francisco-based Ninth Circuit, which will hear any appeal. But Stimson suggested DOJ may have a longer-term objective beyond winning an immediate injunction: establishing a legal record that could support further proceedings after the election, once the votes are counted.TRUMP PROSECUTIONS UNDER BIDEN SET PRECEDENT FOR DOJ’S ALASKA ‘DECOY DAN’ PROBE, EX-FEC CHAIR SAYS”They may be filing these suits to establish a record and force Alaska and others supporting the status quo to defend what’s happening, knowing that there’s some level of confusion and they have the legal wheels churning,” he said. “So after the vote is [over], they’ve started the legal wheels rolling.”Former Assistant U.S. Attorney for North Florida Zack Smith added that if the Ninth Circuit does not hear the case promptly, DOJ could seek emergency review from the U.S. Supreme Court. While the Alaska case is considered unprecedented, according to the experts, the idea of a Supreme Court expedition at election time is not.On Dec. 9, 2000, one day after the Florida Supreme Court ordered a manual recount of disputed ballots in the Bush v. Gore presidential election dispute involving “hanging chads,” then-Texas Gov. George W. Bush’s legal team successfully sought emergency intervention. The court ultimately decided in Bush’s favor within a week.Since the disputed 2000 election, which featured “hanging chads” on hole-punched paper ballots and the Brooks Brothers Riot at the Miami-Dade elections office, DOJ has become well-accustomed to the expedited-review process, the experts said.FEDERAL JUDGE BLOCKS TRUMP DOJ’S THREATS AGAINST ELECTION WORKERS AHEAD OF 2026 MIDTERMS”DOJ is familiar with kind of working quickly, getting things to the Supreme Court, and so I wouldn’t be completely surprised if you were to see something like that,” Smith said.Bush v. Gore offers a procedural parallel because federal courts were asked to intervene in the administration of a state-run election.”Florida was conducting the election in the manner under Florida law, under this time, place and manners set out by Florida law even though it was a federal election,” Stimson said. “They used a particular type of ballot, which had those so-called dangling chads, which were punch-holes that didn’t come the whole way off, so the hole was left with a little tag, essentially like a skin tag, and eventually the Supreme Court of Florida ruled.””But because there were federal violations, eventually the Supreme Court weighed in and stopped it, And at no point in time had the vice president’s (Albert Gore) vote count ever surpassed that of the governor (Bush) and because it was a federal interest, the Supreme Court stepped in and stopped this counting at the state level.”Alex Charns, an attorney who has argued in federal court, told Fox News Digital that the clock has run out and DOJ’s goal of segregating ballots based on voter intent is no longer possible.”I’ve litigated against the USDOJ for over thirteen years in federal court. I’ve practiced law in Durham, NC for 43 years. The USDOJ filed a case without legal merit and its appeal is likely to fail,” he said.”In addition, voting ends [Tuesday]. The relief they seek isn’t possible – ballots already case can’t be segregated. Also, one cannot tell why any voter voted in a particular way. The appeal is unlikely to be successful.”SIGN UP TO GET THE POLITICS NEWSLETTERIn a statement from the DOJ’s “Rapid Response” office, a spokesperson said the court “dismissed the case on procedural grounds but did not dispute the argument of the United States that Daniel J. Sullivan (a/k/a Decoy Dan) entered the race as a frivolous candidate to confuse voters.””Alaskan voters deserve a fair election, not to be misled in an attempt to rig outcomes,” DOJ-RR said, announcing their appeal.Stimson cautioned that the outcome of the civil litigation would have little bearing on the separate criminal investigation, which could uncover evidence supporting additional legal action even if DOJ’s appeal fails.”As long as that criminal investigation is going on, you’re not breathing easy,” he said, adding that evidence uncovered by federal investigators could potentially provide grounds for a separate civil lawsuit.

Hochul silent about women under attack in America’s largest city as Dem candidate steers outrage elsewhere

“We Want To F**k Leipzig”: Germany Vows Tough Response As Migrant Youths Admit Real Motives Behind Protests

Authored by Remix News Staff via Remix News,Following clashes with police and looting during the Gen Z protests on Halloween night in Germany, one interviewer attempted to speak with a group of migrant youths in the city of Leipzig about their motivation for protesting.During the video, they openly admit they want to rob stores, fight police, and “f**k Leipzig” – not for better schools or climate action as organizers are claiming.Eindrücke von gestern. One said, “We just want to rob stores.” Another declared, “We want to fight with police officers,” adding, “Everyone’s lying. We want to fight police officers.” He made the comment after another of the youths claimed they were there for better schools.A third yelled, “We want to f**k Leipzig!”The youths also linked the protests to Palestine and Gaza, stating multiple times that they wanted to “Free Gaza.”The motives for protesting also do not appear that different from recent interviews with migrant youths in Belgium following the riots there, where respondents said they did not know why they were protesting and they were simply there to “smash everything.”These admissions align with the rapid escalation of the Oct.31, 2026, “Gen Z regelt” (“Gen Z takes charge”) protests. What began as largely peaceful daytime marches across roughly 30 to 34 cities, drawing tens of thousands, deteriorated after dark as masked groups took over.Burning barricades appeared while protesters hurled stones, fireworks, bottles, and Molotov cocktails at officers. Frankfurt’s Zeil shopping street saw some of the worst cases of violence and looting in Germany.Earlier this year, Remix News wrote a special report about Frankfurt’s status as Germany’s most diverse city and the associated problems it has brought, including for Frankfurt’s main shopping district.🇩🇪🔴 JUST IN: German police were attacked with a Molotov cocktail in the city of Frankfurt on Halloween night. Cologne also saw clashes next to the famed Cologne Cathedral.Federal Interior Minister Alexander Dobrindt (CSU) said some looting occurred in front of live cameras, that perpetrators would be identified, and that he expected “harsh penalties.”He blamed “violent left-wing groups and troublemakers from migrant communities” for hijacking the afternoon’s peaceful protests.North Rhine-Westphalia Interior Minister Herbert Reul (CDU) condemned the riots, stating the protests had been co-opted by left-wing extremists and groups of violent young men who deliberately escalated: “Anyone who throws stones and firecrackers at police officers, sets off pyrotechnics and rampages through the streets has no political agenda. People who disguise themselves don’t want to discuss or convince. They want trouble and violence. The group later distanced itself from the violence, saying it had no control over what happened after the official events ended, and announced further actions. As a result of all that Rachel Roberts reports, via The Epoch Times, that German ministers have said there will be tough penalties for those who engaged in Saturday night’s riots and looting, which left more than 100 police officers in Frankfurt injured.German Interior Minister Alexander Dobrindt blamed “troublemakers from the immigrant community” for the criminality that emerged. He did not provide evidence to support the claim or say which groups joined the demonstrations. As in France, the largely peaceful daytime protests were followed by nighttime unrest.Dobrindt, a member of the conservative Christian Social Union from the coalition government, said authorities would identify those responsible and bring them to justice.”I expect there to be severe penalties. We are not prepared to accept, in the slightest, that such incidents and such rioting should take place here,” he told reporters on Sunday. He said a strategy based on a large security presence and officer deployments across multiple locations had proved effective in containing the violence.Located in the western state of Hesse, Frankfurt was the main flashpoint for the weekend’s violence, although there were attacks against the police in other cities, including Berlin and Cologne.Organized by the campaign group “Gen Z regelt” (“Gen Z takes charge”), the protests demanded better education and lower living costs.Hesse Interior Minister Roman Poseck said that many of those involved in the criminal activity in Frankfurt were German nationals with an immigrant background, citing police information.Violence included windows being smashed and the use of petrol bombs, while rocks and bottles were thrown at emergency service personnel.Speaking at a press conference on Sunday, Poseck said hooded rioters damaged 17 stores in Frankfurt, the country’s financial hub, looting five of them, according to police. He added that police deployed 1,300 officers and detained 54 people aged 13 to 29.”Police currently estimate that they are dealing with between 1,000 and 1,500 violent troublemakers, predominantly from an immigrant background,” Poseck said. “I am shocked by what I have seen, and there is no point in sugar-coating it. Let me make this very clear: Things cannot go on like this.”There was also violence in Cologne on Saturday night. Police used water cannons to disperse the crowd, while in Berlin, some among the crowds of demonstrators attacked police with bottles and fireworks. In France, protests continued on Halloween for a third consecutive weekend after extensive riots and looting across several cities on Oct. 17 left the country reeling.Dobrindt said that border controls had been tightened ahead of the protests because of concerns that extremist groups from abroad might use them to stir up trouble.Germany is governed by a coalition between the center-right Christian Democratic Union (CDU); its Bavarian sister party, the Christian Social Union (CSU); and the center-left Social Democratic Party (SPD). Chancellor Friedrich Merz, of the CDU, leads the government, which took office in May 2025.In recent years, Germany has seen a surge in support for the populist Alternative for Deutschland (AfD), a socially conservative party that supports strict immigration controls.’No Consequences to Fear’The party is currently leading the national opinion polls. An INSA survey from Oct. 30 puts the populist party at 29 percent.AfD’s co-leader Alice Weidel said in a Nov. 1 post on X that riots were a result of CDU policy that has “courted and promoted left-wing extremism for years, coupled with uncontrolled migration, in which perpetrators have no consequences to fear whatsoever.”Weidel added: “Last night must finally have consequences – and those can only be drawn by the AfD.”Despite its rising popularity amid widespread discontent over mass immigration and economic stagnation, the AfD faces obstacles to governing. The other major parties say they will maintain a firewall strategy and not form a coalition with the AfD, with the next national election due in 2029.In prepared remarks for a CDU conference beginning on Monday, Merz stated, “Violence has no place on our streets, and my government will show no tolerance,” German public broadcaster ARD reported.

Mark Cuban says your 401(k) is part of the healthcare problem

November 3, 2026 MMN Editor Filed Under: SUCCESS, The Street

Mark Cuban has a habit of saying things that make people uncomfortable. His latest target is not a specific executive or a federal policy. It is your retirement account.

In a post on X, Cuban argued that anyone whose retirement fund holds shares of the biggest health insurance companies is financially propping up the industry he has spent years criticizing.

“If you own shares in a fund that owns any of the biggest insurance carriers, you are part of the cost of health care problem in this country,” he wrote. He urged investors to pressure the funds they own to dump those positions.

Most workers are not picking individual insurance stocks. They are in index funds. And index funds, almost by design, own major health insurers. That is the tension Cuban is putting on the table.

62% of Americans own healthcare stocks without knowing it

About 62% of Americans own stocks directly or indirectly, according to Gallup research. Most of them are not buying shares of UnitedHealth Group or CVS Health on their own. They are contributing each month to a target-date fund at work, or an S&P 500 index fund, or a total-market fund. Those vehicles hold large-cap companies across every sector. The biggest health insurers are large-cap companies. The math is straightforward.

Also read: Mark Cuban just picked a fight that goes beyond his usual beat

The healthcare sector represents roughly 10% of the S&P 500 by weight. That includes insurers, but also drugmakers, device manufacturers and hospital systems. Cuban’s call to divest is aimed specifically at the largest insurance carriers, not the entire sector. The distinction matters when you start thinking about what to do.

Cuban has argued that publicly traded health insurers prioritize share prices over patients, families and workers. He built Cost Plus Drugs specifically to undercut pharmacy pricing. His position on the broader system is not new. What is new is pointing the finger directly at retirement savers.

What a typical 401(k) actually holds

Employer-sponsored plans typically offer a short menu of funds, not open brokerage accounts where you pick individual stocks. Choose from that menu and you are almost certainly going to end up in a broad index fund. S&P 500 trackers, total-market funds, and target-date funds all buy the entire market. There is no checkbox to remove a single company from the mix. Whatever is in the index is in your account.

Target-date funds work the same way. They hold equities, bonds and other assets in proportions that shift as the target year approaches. Within the equity sleeve, you will usually find full market exposure, including healthcare.

Cuban’s point is not that having a 401(k) is wrong. It is that most workers have never looked at what their fund actually holds. A worker who wants lower premiums and a more transparent billing system may be unknowingly benefiting every time the insurers in their fund post a strong earnings quarter. That conflict is real, even if it is not intentional.

Mark Cuban has a habit of saying things that make people uncomfortable. His latest target is not a specific executive or a federal policy. It is your retirement account.Halfpoint Images / Getty Images

Options for investors who want out of insurance stocks

Not every 401(k) plan offers ESG or socially responsible fund options. Whether yours does depends on what your employer negotiated with the plan provider. If those options exist, the screening criteria vary and the fund name does not always tell you much.

A fund marketed as healthcare-conscious might exclude tobacco or weapons but still hold stakes in hospital chains and device manufacturers. Before switching, pull up the actual holdings list and read it. The expense ratio will usually be higher than that of a plain index fund, too.

Outside of a 401(k), you have more flexibility. Individual stocks and specialized ETFs let you build around specific companies. That adds concentration risk. Narrowing any portfolio does.

A third option Cuban specifically named is shareholder engagement. If you own shares in a fund, you have voting rights. You can vote against executive compensation packages, support shareholder proposals on pricing transparency or submit your own proposals. That is a slower lever, but it is a real one. Shareholder voting is one of the tools Cuban said investors are not using enough.

The broader cost problem Cuban keeps coming back to

The average annual cost of employer-sponsored family health coverage reached $28,303 in 2026, up 5% from the prior year, according to KFF. Workers paid $7,471 of that on average. Cuban’s argument is that those costs ripple into hiring decisions, wages, and benefit cuts. When companies spend more on premiums, there is less available for raises or new positions.

Americans spent $14,775 per person on healthcare in 2024, compared with $7,860 on average across comparable high-income countries, according to the Peterson-KFF Health System Tracker. Cuban has framed publicly traded insurers as a driver of that gap. Their business model is built around generating returns for shareholders, he argues, not minimizing patient costs.

The broader argument is that healthcare spending does not stay inside the healthcare system. It affects wages, hiring, retirement security and consumer prices. Cuban’s case is that investors have more leverage over that dynamic than they realize, and most of them are not using it.

What this actually means for your retirement account

Stopping contributions or cashing out a 401(k) over this would not make financial sense for most workers. The employer match alone is compensation you have earned and would forfeit. On top of that, you lose the tax deferral on decades of future contributions. That is a significant amount to give up over an indirect ownership stake in one insurance company. Cuban has not suggested people should do it.

What Cuban is actually arguing for is informed ownership. Know what your fund holds. If your plan offers a values-based option that fits your situation, understand its fees and actual holdings before you switch. Use whatever shareholder tools your fund manager makes available. A fee-only financial advisor can help you run the numbers before you make any changes.

The practical question is whether your portfolio reflects your financial goals and your values. For most workers, the answer involves staying invested and adjusting around the edges rather than overhauling the account. Cuban’s argument is worth taking seriously. It is also worth understanding what it does and does not require you to do.
